• This Release & Indemnity Agreement (“Release”) is made by the undersigned adult (the “Participant”), to release and indemnify Naya Yoga & Pilates Fitness Club LLC as set forth below. Naya Yoga & Pilates Fitness Club LLC, a Dubai Limited Liability Company, and all of its subsidiaries, including but not limited to the successors, assignees, employees, officers, directors, agents, contractors and shareholders of Naya Yoga & Pilates Fitness Club LLC and its subsidiaries, and all persons, corporations, partnerships and other entities with which Naya Yoga & Pilates Fitness Club LLC and its subsidiaries are or may in the future become affiliated (collectively, “Naya Yoga & Pilates”).
• The Participant, on the Participant’s own behalf and on behalf of the other members of the Participant’s family, including the Participant’s spouse, parents, children, heirs, and assigns (singularly and collectively referred to as “Participant”) hereby grants to Naya Yoga & Pilates this full release and indemnification as consideration in exchange for Reform Athletica permitting the Participant to participate in Naya Yoga & Pilates Classes, including but not limited to the Reform Method, TRX Athletica and any other classes released or scheduled at Naya Yoga & Pilates from time to time, at Villa 40, 165a Jumeirah Road, Jumeirah 1 (hereon referred to as “Naya Yoga & Pilates Classes”).
• The Participant is entering into this Release after having viewed or having had the opportunity to view the site of Naya Yoga & Pilates’s exercise classes (www.naya.ae); having had the scope of the classes offered and associated risks explained; and having had an opportunity to ask questions regarding the classes and risks associated with any Naya Yoga & Pilates Classes.
• The Participant is voluntarily participating in the Naya Yoga & Pilates Classes with full knowledge, understanding and appreciation of the risks inherent in any physical exercise and expressly assumes all risks of injury and even death that could occur by reason of the Participant's participation.
• The Participant hereby releases, waives, discharges and covenants not to sue Naya Yoga & Pilates from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or relating to any loss, expense, damages or injury, including death, that may be sustained by the Participant, or to any property belonging to the Participant, whether caused by the negligence of Naya Yoga & Pilates, or otherwise as a result of participating in the Naya Yoga & Pilates Classes.
• The Participant hereby assumes full responsibility for any and all risks of bodily injury, property damage or death to the Participant due to the ordinary negligence or gross negligence of Naya Yoga & Pilates and the ordinary negligence, gross negligence, or wilful misconduct of any third party including others participating in the Reform Athletica Classes.
• The Participant agrees to indemnify, defend, and hold harmless Naya Yoga & Pilates at the Participant’s sole cost from any and all claims arising out of the Participant’s participation in the Naya Yoga & Pilates Classes.
• All personal property brought to the Naya Yoga & Pilates Classes is brought at the sole risk of the Participant as to theft, damage, or loss.
• The Participant is aware the entire premises is monitored by 24/7 Video Surveillance and has no objection to being recorded.
• The Participant expressly agrees that the terms of release and the indemnity contained herein are intended to be as broad and inclusive as is permitted by the laws of the United Arab Emirates. Any provision of this Release found to be invalid by the courts having jurisdiction shall be invalid only with respect to such provision or portion and all other provisions shall remain in full force and effect.
• This Agreement supersedes all prior discussions and agreements with respect to the Naya Yoga & Pilates Classes and shall be interpreted according to the laws of the United Arab Emirates without regard to choose of law provisions. By creating an account and signing up to participate, I acknowledge that I have read and fully understand and accept the terms of this Release and represent and agree my agreement is freely and knowingly given.

Packages cannot be refunded, extended or transferred. Please choose carefully.
Always signing-in at the reception before attending the class or you will be marked absent.
To ensure availability, pre-registration is strongly encouraged. Failure to cancel your session 12 hours before the start time will result in an automatic charge, under any circumstances.
Late arrivals (more than 10 minutes from class starts) will not be permitted to enter the class.
Grip Socks are required for all reformer classes.
If you discover, or suspect, you are pregnant, please advise the studio and instructor before you commence another class.
Personal items must be stored in the lockers. The studio is not responsible for the lost or missing items.Unclaimed personal items for 3 months will be disposed. For the water bottle 1 month only.

DISCLAIMER
I have disclosed all medical conditions and injuries, both past and present, to Naya Yoga and Pilates, Dubai, UAE and advise that I am fit and able to participate in a Pilates/Yoga session.
I understand that any exercise programme has certain risks and that neither the proprietors or staff or instructors of Naya Yoga and Pilates shall be liable for the death of, or for any disease, injury or physical condition sustained or suffered by myself or any patron in the course of, or arising out of, or in consequence of, my partition in these classes or private sessions or for any injury, loss or damage suffered by any patron while he/she remains on premises of Naya Yoga and Pilates or any venue which that company may lease, hire or utilize.
I acknowledge that I understand the Naya Yoga and Pilates terms and conditions and pregnancy policy detailed above and agree to accept and abide by these policies, terms and conditions.
